Welcome to Genarrator. These Terms and Conditions ("Terms") form a legally binding agreement governing your access to and use of the Genarrator website (the "Service") and any related services provided by Genarrator.
By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to all of these Terms, please do not use the Service.
1. Description of Service
Genarrator is a storytelling platform that allows users to generate children's stories and multivoice audiobooks based on user-provided prompts and parameters.
2. Account Registration and Eligibility
- Eligibility: You must be at least 18 years old to create an account. The Service is strictly intended for use by adults (parents, teachers, creators) to generate content for children.
- Accuracy: You agree to provide accurate, current, and complete information during the registration process and to promptly update such information to keep it accurate.
- Security: You are responsible for safeguarding your password and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
3. Subscriptions, Payments, and Billing
- Billing: All payments are processed securely via our designated third-party provider, Lemon Squeezy. By subscribing or making a purchase, you agree to their respective terms of service and authorize the processing of payments.
- Plans: Features, credit allocations, and capabilities vary by subscription plan. We reserve the right to modify pricing and plan details with reasonable notice.
- Recurring Billing: Subscriptions are billed on a recurring, periodic basis (monthly) until explicitly canceled.
- Cancellations: You can cancel your subscription at any time through your Billing Dashboard. Access to premium features will persist until the conclusion of the current billing period.
- Refunds: All purchases are subject to our Refund Policy.
4. User Content and Conduct
- Prompts: You retain all ownership rights to the original prompts and inputs you provide to the Service. By submitting prompts, you grant Genarrator a license to use them solely for the purpose of operating and improving the Service.
- Prohibited Content: You agree not to submit prompts that are illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of another's privacy, or otherwise objectionable.
- Usage Restrictions: You shall not use the Service to: (a) engage in unauthorized scraping, data mining, or automated extraction; (b) reverse engineer, decompile, or disassemble any aspect of the Service; or (c) circumvent any access controls or security measures.
5. AI-Generated Content and Disclaimers
- Ownership and License: Genarrator retains all right, title, and interest, including all intellectual property rights, in and to any content generated by the Service (including story text and audio files). Subject to your compliance with these Terms and your specific subscription plan, Genarrator hereby grants you a perpetual, worldwide, non-exclusive, royalty-free, sublicensable license to use, copy, distribute, and create derivative works of such generated content for personal or commercial purposes (provided your subscription plan permits commercial use).
- Accuracy Disclaimer: Genarrator utilizes artificial intelligence to generate content. We make no warranties regarding the accuracy, reliability, completeness, or suitability of the generated stories. AI systems may produce factual errors, hallucinations, or unexpected content.
- Required Review: You acknowledge that non-fiction output and educational content must be reviewed and verified by an adult prior to use with children.
6. Intellectual Property Rights
- Genarrator IP: The Service, including its overall design, underlying software, code, proprietary algorithms, original assets, and all generated output, is the exclusive property of Genarrator and is protected by international intellectual property laws. Your rights to the generated output are limited to the license granted in Section 5 above.
- Trademarks: The Genarrator name, logo, and related marks are our trademarks. You may not use them without our prior written consent.
- Feedback: Any feedback, comments, or suggestions you may provide are entirely voluntary, and we will be free to use such feedback as we see fit without any obligation or compensation to you.
7. DMCA and Copyright Infringement
We respect the intellectual property rights of others. If you believe that any content on the Service infringes your copyright, please contact us with a detailed notice in accordance with the Digital Millennium Copyright Act (DMCA).
8. Third-Party Services
The Service may contain links to third-party websites or services that are not owned or controlled by Genarrator. We assume no responsibility for the content, privacy policies, or practices of any third-party websites or services.
9. Termination
We reserve the right to suspend or terminate your account and your access to the Service at our sole discretion, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GENARRATOR, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THIS SERVICE.
11. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. GENARRATOR EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
12. Dispute Resolution and Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Genarrator operates, without regard to its conflict of law provisions. Any dispute arising from or relating to the subject matter of these Terms shall be finally settled by binding arbitration, except that either party may bring a claim in small claims court if the claim qualifies.
13. Severability and Entire Agreement
If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms, along with our Privacy Policy and Refund Policy, constitute the entire agreement between us regarding our Service.
